1. Definitions & Introduction.

1.1 In this Privacy Policy:

1.1.1 "We", "our", or "us" means Arts with Attitude trading as ArtsWithAttitude.com and our affiliated companies. 

1.1.2 "Users", "you", or "your" means all unregistered visitors and users and registered users and purchasers.

1.1.3 "Website" or "site" means the artswithattitude.com website and all its related services.

1.1.4 "Services" means all of the products &/or offerings that are available from our website.

1.2 Arts with Attitude is greatly concerned about the privacy of its users and visitors and is committed to protecting your information and data security. This privacy policy details how Arts with Attitude, together with any of our affiliated companies, collect, use and share your personal information, as well explaining the data rights you may have in that personal information. 

1.3 This privacy policy applies to all Arts with Attitude users, including all unregistered visitors and users, registered users and purchasers, and to all Arts with Attitude services, including our website and its related services. 

1.4 This privacy policy is not intended to supersede the terms of any contract you have with us or any rights you may have under the applicable data privacy laws. 

1.5 Before accessing or using our services, you should read this privacy policy and ensure you fully understand the practices we observe and perform concerning your personal information. If you read and fully understand this privacy policy, and remain averse to our practices, you must promptly leave and discontinue all use of any of our services.

2. What Personal Information do we collect?

2.1 To provide you with services, we must collect personal information from an identified or identifiable person. We collect personal information you provide us, from your use of our services and other sources. Here are the types of personal information we collect about you:

2.1.1 Information you provide us - When you register your details to open a members account, subscribe to our mailing list, blog or promotional updates, purchase products or services, use our services, or contact us directly by any communication means, you may provide us with personal information, such as your name, email address, phone number, payment information or other personal or sensitive details. 

2.1.2 Information we collect when you use our services - When you visit &/or use any of our website services, we may collect a combination and accumulation of personal information, such as visitors' and user's browsing, click path or clickstream activity on the services, session scrolls and heatmaps, non-identifying personal information regarding the visitor's or user's device, operating system, internet browser, screen resolution, language settings, internet or data service provider, referring and exit pages, date and time stamps, etc.

2.1.3 Information we collect from other sources - We may receive personal information about you from third-party sources, such as security providers, fraud protection and prevention providers or social media platforms. We may collect personal information from lead enhancement organisations which can help us improve our service offering, or from marketing and advertising partners that help us manage, measure and monitor our advertising campaigns.

3. Why do we collect Personal Information? 

3.1 We use your personal information for the following reasons: 

3.1.1 To provide and operate our services.

3.1.2 To further improve, develop, extend or modify our services based on common user personal preferences, experiences and issues.

3.1.6 To facilitate, sponsor, and offer certain contests, events, and promotions, determine participants' eligibility, monitor performance, contact winners, and grant prizes or benefits.

3.1.7 To analyse our performance and marketing activities. 

3.1.8 To create an accumulation of statistical data and other aggregated &/or inferred information, which we, or our business partners, may use to provide and improve our respective services.

3.1.10 To improve our data security and fraud prevention capabilities.

3.2 We may use techniques like machine learning to help us improve our services. If we use this technique, we either still have a person involved with the process, or use the technique in ways that do not have significant privacy implications. We may also use such techniques to help us monitor, identify and suspend accounts sending spam, or engage in abusive or fraudulent behaviour. 

3.3 We use your personal information for the purposes set out in section 3 where:

3.3.1 Our use of your personal information is necessary to perform a contract or to undertake steps to enter into a contract with you (e.g. provide you with products or services or assist you with any customer services.)

3.3.2 Our use of your personal information is necessary to comply with our relevant legal or regulatory obligation.

3.3.3 Our use of your personal information is necessary to support legitimate interests and business purposes, like maintaining and improving our services and identifying technical issues, provided it is conducted in a way that is proportionate and respects your privacy rights.

4. How we share your Personal Information.

We may share your personal information (or allow access to it) with service providers and others in the following ways and occurrences:

4.1 Third-Party Service Providers - We have partnered with several selected service providers where their services or solutions improve, expand and strengthen our own. These include hosting and communications services, data and cybersecurity services, billing and payment processing services, fraud detection and prevention services, web analytics, e-mail distribution and monitoring services, data optimization and marketing services, shipping and delivery services, framing services, and our legal and financial advisors. These are collectively known as Third Party Service Providers.

We may share the following types of personal information with Third Party Service Providers for business purposes:

4.1.1 Identifiers - Name, title, alias, address, unique personal identifier, online identifier, IP Address, email address, account name, or other similar identifiers. 

4.1.2 Commercial Personal Information - The likes of personal information regarding products or services purchased, acquired, or considered.

4.2 Law Enforcement, Legal Requests and Duties - We may disclose or otherwise allow access to any type of your personal information outlined in this policy if there is an appropriate legal request, like legal proceedings, a court order, search warrant, or in compliance with applicable laws if we have the belief and understanding that the law requires us to do so and with or without notice to you. 

4.3 Protecting Rights and Safety - We may disclose any type of your personal information outlined in this policy if we believe with the reason that this will help protect the rights, property, or personal safety of our company, our users, or public members, with or without notice to you.

4.4 Concerning a change of company ownership or control - If Arts with Attitude or any of its affiliates undergo any change in control, including a merger, acquisition or substantial purchase of all of its assets, your personal information may be shared with the parties involved. 

4.5 Social Media Features - Our services may enable you to utilize certain Social Media features like single sign-on capabilities with "Facebook Connect" or "Google Sign-In". These social media features may collect certain personal information from you, such as name, title, alias, address, unique personal identifier, online identifier, IP Address, email address, or other similar identifiers. Social Media Features are hosted by a third party or by our services. Please note that in this example, we simply act as an intermediary platform allowing you to utilize such third-party services with which you are interacting directly, and at your discretion. In this respect, we act as a service provider to you, disclosing information to the third-party services on your behalf. We shall share users' personal information with third-party services only upon your discretion or with your permission and is not, and shall not be, in any way responsible for such third-party services processing of such personal information, or liable concerning that. 

4.6 We do not control and are not responsible for the actions or the policies of any third-party service, and your use of any third-party service is at your own risk. We recommend reviewing any privacy policy accompanying a third-party service and asking such third-party service for any clarification you may need before deciding to use their services.

5. Where do we store or process your Personal Information? 

5.1 Our company website is hosted on the Wix.com platform. Wix.com provides us with an online platform that allows us to sell our products and services to you. Your data may be stored through Wix.com's data storage, databases and the general Wix.com applications. They store your data on secure servers, behind firewalls, with a stringent security perimeter and strict controls. 

5.2 Wix processes personal data across the world and may transfer your personal information outside of your country. Your security, privacy and confidentiality are their top priority. Wix conducts a vetting process that includes an assessment of the privacy laws in those countries to validate they have strong data protection laws. 

5.3 Wix may store and process personal information in the USA, Europe, Israel, or other jurisdictions, whether by themselves or with the help of their affiliates and service providers. Wix's data storage providers are contractually committed to protecting and securing your data.  

5.4 User's personal information is controlled by Wix.com Ltd. in Israel, which the European Commission considers is a country offering an adequate level of protection for the personal information of E.U. Member State residents.

5.5 If you are in Europe, the UK, or Switzerland, if Wix transfers your personal information to a location outside of Europe, they will make sure there is a level of protection deemed adequate by the European Commission or that the relevant Standard Contractual Clauses are in place. 

5.6 All direct payment gateways offered by Wix.com and used by our company adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint conglomeration of financial organisations like Visa, Mastercard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of payment card information by our store and its service providers.

6. Users-of-Users' Personal Information.

6.1 Wix may collect, store and process certain personal information of Users-of-Users, solely on our behalf and at our discretion. For such purposes, Wix serves and shall be considered as a "Processor" and not as the "Controller". We shall be considered as the "Controller" of such Users-of-Users information, and are responsible for complying with all laws and regulations that may apply to the collection and control of such information, including all privacy and data protection laws of relevant jurisdictions.

6.2 Wix has no direct relationship with Users-of-Users whose personal information it processes. If you are a visitor, user or customer of Arts with Attitude, and would like to make any requests or queries regarding your personal information, please contact us directly.

7. Communications from Arts with Attitude.

7.1 We may use your personal information to send you promotional content and messages by email, text messages or similar forms of communication from Arts with Attitude through such means. If you do not wish to receive such promotional messages or emails, you may notify Arts with Attitude at any time or follow the "unsubscribe", "stop" or "change your email preferences" instructions contained in the communications you receive. 

7.2 We may contact you to notify you regarding your account, to troubleshoot problems with your account, to resolve a dispute, to collect fees or monies owed, to confirm an order, to confirm a shipping/delivery, to poll your opinions through surveys or questionnaires, to send updates about our company, or as otherwise necessary to contact you to enforce our user agreement, applicable national laws, and any agreement we may have with you. For these purposes, we may contact you by email, telephone, text messages, and postal mail. 

7.3 We may also contact you with important information regarding our Services, or your use of them. We may send you a notice if a certain service is temporarily unavailable, reply to your email, forward abuse complaints, or notify you of material changes to our Services, Terms or Policies. It is important that you can receive such messages.

8. Your rights regarding your Personal Information.

8.1 We believe it is essential that all Arts with Attitude users have control over their personal information. Depending on the way you use our services, you may have the right to request access to, receive a copy of, update, amend, delete, restrict, or object to certain uses of your personal information (like direct marketing purposes). When we rely on your consent for processing your personal information you can withdraw your consent at any time, and such withdrawal will take effect from then on. 

8.2 We will not charge you anything if you exercise any of these rights and will continue to provide you with the same level of service. 

8.3 If you are a user of our website, you can access and correct some of your personal information directly through your account, or if we make an online form available to you. You can exercise your rights by sending your request to privacy@artswithattitude.com, or by reaching out to us using one of our contact forms.

8.4 When we receive your right request, we may take steps to verify your identity before complying with the request to protect your privacy and security. Before fulfilling your request, we may ask you for additional information to confirm your identity and for security purposes. We reserve the right to charge a fee where permitted by law if your request is unfounded or excessive. 

8.5 You have the right to file a complaint with your local supervisory authority for data protection, but we do recommend that you contact us first so we can look to resolve the situation. 

8.6 If you wish to receive a copy, access &/or request us to make corrections to the personal information that you have stored with us, or wish to request a list of what personal information (if any) relating to you we disclosed to any third party, email your request to privacy@artswithattitude.com, or by reaching out to us using one of our contact forms. We will make a reasonable effort to honour your request promptly, subject to legal and other permissible considerations.

8.7 Please note that permanently deleting your account erases all of your personal information from our databases. After completing this process, you can no longer use any of our account services, your account and all its data will be removed permanently, and we will not be able to restore your account or retrieve your data in the future.

9. Cookie Usage & Other Tracking Technology.

9.1 We and our Third Party Service Providers use cookies and other similar technologies for us to provide our service and ensure it properly performs, analyze our performance and marketing activities, and personalize your experience. These technologies are mostly used for security, functionality, performance, stability and advertising purposes.

9.2 Please note that we do not change our practices in response to a "Do Not Track" signal in the HTTP header from a browser or mobile application. However, most browsers allow you to control cookies, including whether or not to accept them and how to remove them. You may set most browsers to notify you if you receive a cookie, or may choose to block cookies with your browser.

10. Retaining Data. 

10.1 Wix and ourselves may retain your personal information, and your users-of-user's personal information for as long as your account is active, as indicated in this privacy policy, or as otherwise needed to provide you with our services. 

10.2 We may continue to retain your personal information after you deactivate your account &/or cease to use any particular services, as reasonably necessary to comply with our legal obligations, to resolve disputes regarding our users or their users-of-users, prevent fraud and abuse, enforce our agreements &/or protect our legitimate interests. 

10.3 To determine the right retention period for personal information, we consider the amount, nature, and sensitivity of such data, the potential risk of harm from unauthorized use or disclosure, the purposes for which we process it, and applicable legal requirements.

11. Security.

11.1 Wix has implemented security measures designed to protect the personal information you share with us, including physical, electronic and procedural measures. Some of the secure elements Wix and ourselves offer are:

11.1.1 HTTPS secure access to all areas of our site.

11.1.2 The transmission of sensitive payment information through our designated purchase forms is protected by an industry-standard SSL (Secure Sockets Layer)/ TLS (Transport Layer Security) encrypted connection.

11.1.3 Regularly maintained Payment Card Industry Data Security Standards (PCI-DSS) certification. Wix Payments is PCI-DSS compliant and accredited as a level 1 service provider and merchant.

11.1.4 Wix is compliant with ISO 27001, ISO 27701, ISO 27017 & ISO 27018. These ISO certifications outline industry best practices for managing security risks, privacy information management, security techniques in a public cloud computing environment and security techniques for PII protection in a public cloud computing environment.

11.1.5 Databases containing sensitive information are encrypted according to PCI standards, to add additional protection of personally identifiable information. This encryption method leaves the information unreadable without a cryptographic key.

11.1.6 Wix has a multiple-layer security architecture to help protect against 0-day security issues.

11.1.7 Wix uses cryptography hash functions to protect your information. Your password is stored as a hash digest and, in the event of a security breach, your original password cannot be recovered from their servers.  

11.1.7 Wix also regularly monitors their systems for possible vulnerabilities and attacks and regularly seeks new ways and third-party services for further enhancing the security of their services and the protection of our visitors and users' privacy. 

11.2 Regardless of the measures and efforts taken by Wix and ourselves, we cannot and do not guarantee the absolute protection and security of your personal information, users-of-users' personal information or any other information you upload, publish or otherwise share with us or anyone else. We encourage you to set strong passwords for your user account and avoid providing us or anyone with sensitive personal information which you believe its disclosure could cause you substantial or irreparable harm. 

11.3 Since email and instant messaging are not recognized as secure forms of communication, we request and encourage you not to share any personal information on any or by any of these methods.

12. Third-Party Websites.

12.1 At times our services may contain links to other websites or services. We are not responsible for such websites or services' privacy practices. We encourage you to be aware when you leave our services and to read the privacy statements of every website and service you visit before providing your personal information. This privacy policy does not apply to such linked third-party websites and services.

13. Public Forums and User Consent.

13.1 Our services may offer publicly accessible blogs, communities and support forums. Please be aware that any personal information you provide in any such areas may be read, collected, and used by others who access them. To request the removal of your personal informaton from our blogs, communities or forums, contact us at privacy@artswithattitude.com, or by using one of our contact forms. In some cases, we may not be able to remove your personal information from such areas. For example, if you use a third-party application to post a comment (e.g. via Facebook social plugin application) while logged into your related profile with a such third party, you must log in to such application or contact its provider if you want to remove the personal information you posted on that platform. 

13.2 In any event, we advise against posting any personal information via any means you do not wish to publicize. 

13.3 If you upload any user content to your Account or provide it in any way as part of the use of our services, you do so at your own risk. We have put adequate security measures in place to protect your personal information. However, we cannot control the actions of other users or public members who may access your user content, and are not responsible for the circumvention of any privacy settings or security measures we may have placed on our site. You understand and acknowledge that, even after its removal by you or us, copies of the user content may remain viewable in cached and archived pages or if any third parties have copied or stored such user content. Again, we advise against uploading or posting any information you do not wish to be public.

14. Updates & Translation.

14.1 We may update this privacy policy as required by applicable law, and to reflect changes to our personal information collection, usage and storage practices. If we make any changes that we deem significant (in our sole and sincere discretion), we will notify you using one of the communication methods outlined in Section 7 before the change becomes effective. Regarding any updated privacy policy, we will notify you as required by applicable law, seek your consent &/or take any other measures. We encourage you to review this page periodically for the latest information on our privacy practices. Unless otherwise stated, our current privacy policy applies to all information we have about you and your users-of-users, regarding our website and any other services. 

14.2 This privacy policy was written in English and may be translated into other languages for your convenience. If a translated (non-English) version of this privacy policy conflicts in any way with its English version, the provisions of the terms of the English version shall succeed.

Our Data Protection Officer will investigate the complaint and determine if a breach has occurred and what action, if any, to take. We take every privacy complaint seriously and will make all reasonable efforts to resolve your complaint promptly and under applicable law.

15.2 You have the right to file a complaint with your local supervisory authority for data protection at any time, but we do recommend that you contact us first so we can look to resolve the scenario.
